This Privacy Policy explains how Fucharmonk ("Fucharmonk", "we", "us", or "our") collects, uses, discloses and protects personal information when you visit fucharmonk.com/ca, submit an inquiry, or engage our marketing services. It applies to visitors and clients in Canada. If you are visiting from India, the United States, the United Arab Emirates or elsewhere, the policy published for that market applies to you instead.
Fucharmonk is a digital marketing agency working exclusively with interior designers, architects and design-led businesses.
Where we are, and what that means for your information
Fucharmonk is established in India and operates from India. We do not maintain an office, branch, agent or place of business in Canada, and we hold no Alberta or federal business registration. Services to Canadian clients are delivered remotely.
When you submit an inquiry or otherwise share information with us, that information is transferred to, stored in and processed in India, and may also be processed in other countries by the service providers described below. While it is outside Canada it is subject to the laws of the country it is in, and may in defined circumstances be accessible to the courts, law enforcement and national security authorities of that country.
We state this at the top rather than in a footnote because you are entitled to know where your information goes before you decide to send it. We apply the same safeguards to information about individuals in Canada that we apply everywhere we operate, and our contracts with service providers require them to do the same.
You may obtain written information about our policies and practices in respect of service providers outside Canada, and you may put questions about that collection to a person who can answer them, by writing to our Privacy Officer at contact@fucharmonk.com with the subject line "Offshore Processing". We provide this contact because Alberta's Personal Information Protection Act requires an organization using a service provider outside Canada to identify someone who can answer for it, and a general mailbox is not a person.
Which laws apply
Two privacy statutes apply to us at the same time, and that is a feature of our situation rather than an ambiguity in it.
Alberta's Personal Information Protection Act (PIPA) governs how a private-sector organization handles personal information in connection with activity in Alberta, and is overseen by the Office of the Information and Privacy Commissioner of Alberta.
The federal Personal Information Protection and Electronic Documents Act (PIPEDA) applies to personal information that crosses a provincial or a national border, and is overseen by the Office of the Privacy Commissioner of Canada. Because our processing happens in India, every inquiry you send us crosses a national border, so PIPEDA applies to it.
Where the two differ, we follow whichever gives you the stronger protection or the faster answer.
If you are in Quebec, the Act respecting the protection of personal information in the private sector, as amended by Law 25, may apply to you; if you are in British Columbia, that province has its own PIPA. Rather than ask you to determine which statute covers you, we extend the rights set out below to anyone in Canada who asks for them.
Canada's Anti-Spam Legislation (CASL) governs the commercial electronic messages we send, and is dealt with under "How we contact you" below.
Information we collect
Information you provide directly:
Contact and business details you submit through an inquiry form, landing page or advertisement — name, email address, telephone number, business name, city or neighbourhood, the service you are interested in, and the scope or budget range of the work you are considering.
The contents of emails and meetings, including anything you choose to tell us about your practice, your clients or your projects.
Billing and account information if you engage us, which for most clients is handled by our payment processor rather than by us directly.
Information collected automatically:
Device and browser information, IP address, approximate location derived from that IP address, referring URL, pages viewed and time spent on them.
Cookie and similar identifiers set by our analytics and advertising tools, described under "Cookies and tracking" below.
We do not knowingly collect Social Insurance Numbers, driver's licence or health card numbers, passport details, financial account numbers, precise geolocation, biometric information, health information, or any other category treated as sensitive. Please do not send us any of these.
Why we collect it, and on what basis
Canadian privacy law asks that we collect only what a reasonable person would consider appropriate in the circumstances, and that we identify the purpose at or before collection. Our purposes are:
To respond to your inquiry, arrange a conversation and prepare a proposal.
To provide, manage and report on the services you engage us for.
To send commercial electronic messages about our services, where we have your consent under CASL.
To measure and improve the performance of our website, our content and our advertising.
To meet legal, tax and accounting obligations, and to establish, exercise or defend legal claims.
We rely on your consent, which for an inquiry form is given expressly when you submit it, and which you may withdraw. We do not use your information for a new purpose without telling you and, where the law requires it, obtaining fresh consent.
How we contact you
We contact Canadian inquirers by email. There is no Canadian telephone line for this market, we run no telephone or SMS marketing to Canadian numbers, and we do not place calls to your prospects on your behalf — our white-label qualification desk operates in India only, and is not part of what we provide in Canada. If you give us a telephone number, we will use it only where you have asked us to reach you about your own inquiry, or during an active engagement.
Every commercial electronic message we send you will identify us, give a contact address that stays valid for at least sixty days after the message is sent, and carry an unsubscribe mechanism that is readily performed. We give effect to an unsubscribe within ten business days and without requiring you to give a reason or take any further step.
You may withdraw consent at any time by using the unsubscribe link in any message, by replying to it, or by emailing contact@fucharmonk.com. Withdrawing consent to marketing does not stop us contacting you about an engagement that is already running, and does not affect the lawfulness of anything done before you withdrew.
Where we send you a message on the basis of implied consent — for example because you published a business email address without a statement refusing such messages, and our message is relevant to your role — we say so on request and we treat the implied consent as expiring on the timelines CASL sets.
Cookies and tracking
Our website uses cookies and similar technologies for analytics, for measuring advertising performance, and for showing our advertisements to people who have visited the site. These include tools operated by Google and by Meta, which set their own identifiers and are governed by their own privacy policies.
You can control cookies through your browser settings. Blocking analytics or advertising cookies will not stop you using the site or submitting an inquiry.
Your rights
Subject to the exceptions in the applicable statute, you may:
Ask what personal information we hold about you, how we have used it, and to whom we have disclosed it.
Receive a copy of it, in a form that is generally understandable.
Have inaccurate or incomplete information corrected, and ask that the correction be sent to anyone we disclosed it to.
Ask us to delete information we hold about you, subject to records we are required to keep for tax, accounting, or legal reasons.
Withdraw consent, on reasonable notice, subject to legal or contractual restrictions — we will tell you the consequences if withdrawal would prevent us delivering something you have engaged us for.
Object to direct marketing, which you may stop at any time and for any reason.
Complain to the Office of the Information and Privacy Commissioner of Alberta, or to the Office of the Privacy Commissioner of Canada, and you may do so whether or not you have raised the matter with us first.
To make a request, email contact@fucharmonk.com with the subject line "Privacy Request". We will verify your identity by asking you to confirm information we already hold. We will never ask you for a password, a Social Insurance Number, or a financial account number in order to verify a request. We answer within thirty days. Alberta's statute allows longer in defined circumstances and we do not intend to use the extra time; if a request is genuinely complex we will tell you before the thirty days are up, and tell you why.
We do not sell personal information, we do not trade it for anything of value, and we do not knowingly process the personal information of anyone under the age of majority in their province.
Who we share information with
Service providers who host our website, send our email, run our analytics, process payments and store our records — each under contract, only for the purpose we engaged them for, and each of them outside Canada.
Advertising platforms, in the form of the cookie and conversion identifiers described above.
Professional advisers, and authorities where we are legally required to disclose.
A successor entity, in the event of a merger, acquisition or sale of assets, in which case the information stays subject to a policy no less protective than this one.
We do not sell or rent your contact details to third parties for their own marketing.
Automated processing
We do not make decisions producing legal or similarly significant effects about you by automated means alone. Inquiries are scored against criteria we agree with the client whose campaign produced them, and that scoring uses the information the inquiry itself provides. It affects how quickly a human reads your inquiry; it does not decide anything about your rights, your entitlements or your access to a service.
Advertising platforms optimize the delivery of advertisements automatically, which decides who sees an advertisement — not anything about the person who sees it.
How long we keep information
Inquiries that do not become engagements are retained for up to twenty-four months, because in this industry a prospect who is not ready this quarter is frequently ready the year after. Client records are retained for the duration of the engagement and for as long afterwards as tax, accounting and limitation periods require. Records of consent for commercial electronic messages are kept for as long as we may need to prove that consent, because under CASL the onus of proving it is on us. You may ask us to delete sooner and we will, unless we are required to keep it.
Security and breaches
We use access controls, encryption in transit, and reputable infrastructure providers. No method of transmission or storage is completely secure, and we do not claim otherwise.
If a breach involving your personal information creates a real risk of significant harm to you, we will report it to the Office of the Information and Privacy Commissioner of Alberta as that province's statute requires, notify the Office of the Privacy Commissioner of Canada where PIPEDA applies, notify you directly, and keep a record of the incident.
Children
The website is directed to businesses and is not directed to children. We do not knowingly collect information from a minor. If you believe a minor has provided us information, contact us and we will delete it.
Changes
We may update this policy. The "Last updated" date below reflects the most recent revision, and material changes will be described at the top of this page when they are made.
