This Privacy Policy explains how Fucharmonk ("Fucharmonk", "we", "us", or "our") collects, uses, shares and protects personal data when you visit fucharmonk.com/ae, submit an enquiry, or engage our marketing services. It applies to visitors and clients in the United Arab Emirates. If you are visiting from India, the United States or elsewhere, the policy published for that market applies to you instead.
Fucharmonk is a digital marketing agency working exclusively with interior designers, architects and design-led businesses.
Where we are, and what that means for your data
Fucharmonk is established in India and operates from India. We do not hold a United Arab Emirates trade licence, and we do not maintain an office, branch or establishment in the UAE. Services to UAE clients are delivered remotely.
When you submit an enquiry or otherwise share information with us, that information is transferred to, stored in and processed in India, and may also be processed in other countries by the service providers described below.
We state this plainly because you are entitled to know where your information goes before you decide to send it, and because a transfer of personal data outside the UAE is something you should be told about rather than left to infer. We apply the same safeguards to information about individuals in the UAE that we apply everywhere we operate, and our contracts with service providers require them to do the same.
Which law applies
Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data is the UAE's general data protection law, and it is the framework this policy is written against.
If you are in the Dubai International Financial Centre or the Abu Dhabi Global Market, those free zones operate their own data protection regimes — DIFC Data Protection Law No. 5 of 2020 and the ADGM Data Protection Regulations 2021 — which may apply to you instead of the federal law. Rather than ask you to work out which regime covers you, we extend the rights set out below to anyone in the UAE who asks.
Information we collect
Information you provide directly:
Contact and business details you submit through an enquiry form, landing page or advertisement — name, email address, telephone number, business name, emirate or community, the service you are interested in, and the scope or budget range of the work you are considering.
The contents of emails and meetings, including anything you choose to tell us about your studio, your clients or your projects.
Billing and account information if you engage us, which for most clients is handled by our payment processor rather than by us directly.
Information collected automatically:
Device and browser information, IP address, approximate location derived from that IP address, referring URL, pages viewed and time spent on them.
Cookie and similar identifiers set by our analytics and advertising tools, described in the section on cookies below.
We do not knowingly collect Emirates ID numbers, passport or visa details, financial account numbers, precise geolocation, biometric data, health information, or any other category treated as sensitive personal data. Please do not send us any of these.
How we use information, and on what basis
To respond to your enquiry, arrange a call and prepare a proposal — on the basis of the consent you give by submitting the form, and of the steps necessary before entering into a contract.
To provide, manage and report on the services you engage us for — on the basis of performing that contract.
To send marketing communications about our services, where you have consented, and subject to the withdrawal right below.
To measure and improve the performance of our website, our content and our advertising — on the basis of our legitimate interest in running a business, weighed against your rights.
To meet legal, tax and accounting obligations, and to establish or defend legal claims.
How we contact you
We contact UAE enquirers by email. We do not run telephone or SMS marketing to UAE numbers, and we do not pass your number to any dialling operation. If you give us a telephone number, we will use it only where you have asked us to call about your own enquiry, or during an active engagement.
You may withdraw consent to marketing at any time, by replying to any message from us or emailing contact@fucharmonk.com. We will act on the request promptly. Withdrawing consent to marketing does not stop us contacting you about an engagement that is already running.
Cookies and tracking
Our website uses cookies and similar technologies for analytics, for measuring advertising performance, and for showing our advertisements to people who have visited the site. These include tools operated by Google and by Meta, which set their own identifiers and are governed by their own privacy policies.
You can control cookies through your browser settings. Blocking analytics or advertising cookies will not stop you using the site or submitting an enquiry.
Your rights
Subject to the exceptions in the applicable law, you may have the right to:
Ask what personal data we hold about you, where we obtained it, and who we have shared it with.
Receive a copy of it in a structured, machine-readable format, and ask us to transfer it to another controller.
Have inaccurate data corrected and incomplete data completed.
Ask us to erase data we hold about you, subject to exceptions such as records we are required to keep for tax, accounting or legal reasons.
Restrict processing, or object to it — including objecting to direct marketing, which you can stop at any time and for any reason.
Withdraw consent you previously gave, without affecting the lawfulness of processing already carried out on the basis of it.
Complain to the UAE Data Office, or — if you are in a free zone with its own regime — to the DIFC Commissioner of Data Protection or the ADGM Office of Data Protection.
To make a request, email contact@fucharmonk.com with the subject line "Data Request". We will verify your identity by asking you to confirm information we already hold. We will never ask you for a password, an Emirates ID number, or a financial account number in order to verify a data request. We aim to respond within one month, and will tell you if we need longer and why.
We do not sell personal data, and we do not knowingly process the personal data of anyone under 18.
Who we share information with
Service providers who host our website, send our email, run our analytics, process payments and store our records — each under contract, and only for the purpose we engaged them for.
Advertising platforms, in the form of the cookie and conversion identifiers described above.
Professional advisers, and authorities where we are legally required to disclose.
A successor entity, in the event of a merger, acquisition or sale of assets.
We do not sell or rent your contact details to third parties for their own marketing.
Automated decision-making
We do not make decisions producing legal effects about you, or similarly significant effects, by automated means alone. Advertising platforms optimise the delivery of advertisements automatically, which decides who sees an advertisement — not anything about your rights or your entitlements.
How long we keep information
Enquiries that do not become engagements are retained for up to 24 months, because in this industry a prospect who is not ready this quarter is frequently ready the year after. Client records are retained for the duration of the engagement and for as long afterwards as tax, accounting and limitation periods require. You may ask us to delete sooner, and we will unless we are required to keep it.
Security
We use access controls, encryption in transit, and reputable infrastructure providers. No method of transmission or storage is completely secure, and we do not claim otherwise. If a breach affects your personal data, we will notify you and the relevant authority as the applicable law requires.
Children
The website is not directed to children, and we do not knowingly collect information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.
Changes
We may update this policy. The "Last updated" date below reflects the most recent revision, and material changes will be described at the top of this page when they are made.
